Information You Provide

• Account Information: Name and email address when you create an account.
• Assessment Responses: Your answers, inputs, and any text you provide during assessments.
• Assessment Results: Scores, evaluations, and feedback generated from your responses.
• Payment Information: Billing details processed through Stripe. We do not store your full credit card number.
• User Content: Any other text, data, or content you submit through the Services.

Information Collected Automatically

• Usage Data: Pages visited, features used, timestamps, and interaction patterns.
• Device Information: Browser type, operating system, and device type.
• Log Data: IP address, referring URLs, and error logs.
• Location: General geographic location (state/country level) derived from IP address.
• Cookies: Essential cookies for authentication and core functionality.

2. How We Use Your Information

• Provide the Services — generate AI-powered assessments, evaluate your responses, and deliver assessment results
• Share Results with Employers — when you take an assessment through a recruiter invitation, your results are shared with that employer
• Process Payments — manage billing through Stripe
• Improve Our Products — analyze usage patterns to fix bugs and improve features
• Communicate With You — send service-related notices and respond to support requests
• Ensure Security — detect and prevent fraud, abuse, and unauthorized access

3. AI Processing Disclosure

Our Services use artificial intelligence provided by Anthropic (Claude) to generate and evaluate assessments. When you use AI-powered features:

• Your assessment responses are sent to Anthropic for processing and scoring
• We do not send your account information (name, email) to AI providers — only the content necessary to generate and evaluate assessments
• AI-generated evaluations are one input among many and should not be treated as definitive hiring decisions

4. How We Share Your Information

We do not sell your personal information.

Service Providers

We share information with trusted service providers necessary to operate the platform:

• Supabase — Database hosting and authentication
• Anthropic — AI assessment generation and evaluation
• Stripe — Payment processing
• Vercel — Web application hosting

Employers/Recruiters

When you take an assessment through a recruiter invitation link:

• Your assessment responses and results are shared with the inviting employer
• Your name and email may be shared with the employer
• The employer can view your scores, evaluations, and feedback

For self-initiated assessments (not from a recruiter invite), your results are not shared with any employer unless you explicitly share them using your recruiter code or shareable link.

Legal Requirements

We may disclose information if required by law, subpoena, or other legal process.

5. Data Retention

We retain your information according to the following schedule:

• Assessment Data (responses and results): 2 years from the date of assessment completion
• Personal Information (name, email): 1 year after your last account activity, or until you request deletion
• Account Data: Retained while your account is active
• Payment Records: Retained as required by tax and financial regulations (typically 7 years)

After the retention period, data is automatically deleted or anonymized.

6. Your Rights

Depending on your location, you may have the right to:

• Access your personal data
• Correct inaccurate information
• Delete your account and data
• Export your data in a portable format
• Opt out of certain data uses

7. California Privacy Rights (CCPA/CPRA)

• Right to Delete: You can request that we delete personal information we have collected from you, subject to certain exceptions.

• Right to Opt-Out of Sale/Sharing: We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising.
• Right to Limit Use of Sensitive Personal Information: We do not use or disclose sensitive personal information for purposes other than those permitted under CPRA.
• Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

How to Submit a Request

To submit a request to know, delete, or correct your personal information, email us at harrison@clearkreak-ai.com. We may need to verify your identity before processing your request.

8. Data Deletion

You may request deletion of your account and associated data by emailing us at harrison@clearkreak-ai.com. We will delete or anonymize your personal data within 30 days, except where retention is required by law or for legitimate business purposes (such as resolving disputes or enforcing our agreements).

9. Security

We implement reasonable technical and organizational measures to protect your information, including:

• Encryption in transit (TLS/SSL) and at rest
• Secure authentication practices
• Access controls limiting who can view your data
• Regular security reviews

No system is 100% secure. If you believe your account has been compromised, please contact us immediately.

10. Age Requirement

Our Services are intended for users who are 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If you believe we have collected information from someone under 18, please contact us.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or through the Services. Your continued use of the Services after changes take effect constitutes acceptance of the updated policy.
