Terms of Service

Welcome to Mettle. Please read these Terms of Service (“Terms”) carefully before using our products and services.

1. Who We Are

ClearKreak is a C-Corporation incorporated in the State of Delaware. Mettle is a skills assessment platform that helps job seekers demonstrate their abilities and helps employers evaluate candidates. Mettle and any related applications are collectively referred to as the “Services.”

2. Acceptance of Terms

By creating an account or using any of our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services. We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance.

3. Eligibility

You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement.

4. Accounts

To use our Services, you must create an account. You agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure and confidential
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized use of your account

5. Service Description

Mettle provides:

  • For Job Seekers: AI-generated skills assessments based on job descriptions, scored evaluations, shareable results, and verifiable credentials
  • For Employers/Recruiters: Tools to create and distribute assessments to candidates, review candidate results, and manage hiring pipelines

6. Payments, Pricing & Refunds

Some of our Services require payment. By purchasing, you agree to the following:

  • Payment Processing: All payments are processed securely through Stripe. We do not store your full payment card details.
  • Assessment Credits: Purchased assessment credits do not expire but are non-transferable.
  • Subscription Plans: If applicable, subscriptions renew automatically unless cancelled before the renewal date.
  • No Refunds: All sales are final. We do not offer refunds for purchased assessments, assessment packs, or subscription fees.
  • Pricing Changes: We reserve the right to modify pricing at any time. Price changes will not affect previously purchased assessments or active subscription periods.
  • Failed Payments: If a payment fails, access to paid features may be suspended until payment is resolved.

7. AI-Generated Content & Assessment Results

Our Services use artificial intelligence provided by Anthropic (Claude) to generate and evaluate assessments. You acknowledge and agree that:

  • AI output is not professional advice. Assessment results should not be treated as career, legal, or professional advice.
  • No guarantee of accuracy. AI-generated content may contain errors or inaccuracies. You are responsible for reviewing any output.
  • Variability. The same input may produce different outputs at different times.
  • Your responsibility. You are solely responsible for how you use AI-generated content from our Services.

Important Disclaimer About Assessment Results

Mettle assessment results are one data point among many and should not be the sole basis for any hiring decision. Our assessments are designed to provide useful signal about a candidate's skills, but they are not a replacement for comprehensive evaluation including interviews, reference checks, and other assessment methods. Employers using Mettle are responsible for making their own hiring decisions and ensuring compliance with applicable employment laws.

8. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Cheat, use unauthorized assistance, or misrepresent your abilities during assessments
  • Take assessments on behalf of another person
  • Attempt to reverse-engineer, copy, or extract assessment questions or scoring algorithms
  • Interfere with or disrupt the Services
  • Use automated means (bots, scrapers) to access the Services beyond normal use
  • Impersonate another person or entity
  • Submit false, misleading, or fraudulent information
  • Resell or redistribute access without our written permission
  • Use the Services to discriminate against any person based on protected characteristics

We reserve the right to void assessment results if we detect cheating, plagiarism, or other violations.

9. Intellectual Property

Your Content

You retain ownership of all responses and content you submit during assessments. By using the Services, you grant us a limited license to process your content solely to provide the Services (generating assessments, scoring responses, displaying results).

Our Platform

The Services — including their design, code, branding, assessment questions, scoring methodologies, and all other content — are owned by ClearKreak and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform or assessment content without our written permission.

10. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

11. Limitation of Liability

To the fullest extent permitted by law:

  • The Services are provided “as is” and “as available” without warranties of any kind, express or implied.
  • We do not warrant that the Services will be uninterrupted, error-free, or secure.
  • We do not warrant that assessment results will be accurate, complete, or suitable for any particular purpose.
  • ClearKreak shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of employment opportunities, lost profits, or damages arising from hiring decisions.
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless ClearKreak, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit through the Services

13. Termination

By You: You may delete your account at any time by contacting harrison@clearkreak-ai.com.

By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion with notice where practicable.

Upon termination, your right to use the Services ends immediately. Provisions that should survive termination (such as intellectual property, limitation of liability, and indemnification) will continue to apply.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any legal proceedings arising from these Terms or your use of the Services shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

15. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ClearKreak regarding the Services.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver.
  • Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
